Question: Will a standard background check show a DUI/DWI arrest and/or conviction in Maryland?

Answer: The answer is yes. A standard background check will show a DUI—not necessarily an arrest, but certainly a conviction; in many cases, a probation before judgment in the state of Maryland. A probation before judgment is a non-conviction disposition such that you will not get the 12 points and you will not lose your drivers license as a result. But in recent years, Maryland has added the probation before judgment disposition to its Maryland case search, which is easily searchable by the public as a whole. The deeper that the employer gets into looking at one’s record—for example, if they order a full record from the MDA—this will reflect certainly any convictions and also PBJs as well. So, therefore, a standard background check will reflect a conviction, but not necessarily an arrest that did not lead to a conviction. Albeit, that does leave a footprint as well. So if somebody was arrested for DUI and blew a .08 or more and beat it in court, it may not appear on the Maryland case search, but it might appear on a Maryland driving record, depending on what the result of any MDA hearing was.
